Holiday Season Ahead – Be Aware of Unsafe Toys & Products

With the holiday season fast approaching our thoughts are turning to planning for holiday celebrations and purchasing gifts for family & friends. It is important when shopping and purchasing gift items this year to make informed choices, especially when considering toys for babies & children. Every year many children are injured, some seriously, by toys and other children’s products which are unsafe and/or defective.

One great resource available, to check out which unsafe or defective products to avoid, is the Consumer Products Safety Commission. You can also report products you think are unsafe on its website. The CPSC has lists of recalled defective and unsafe consumer products as well as safety education information.

The CPSC was recently responsible for getting the Department of Justice to file legal action against two California companies for importing children’s products containing lead, phthalates and small parts posing a choking hazard for small children under 3. Companies are responsible to follow the law regarding the safety of consumer products. Part of that law means children’s products as well as other consumer products must comply with safety standards set by the Consumer Product Safety Act and the Federal Hazardous Substances Act.

Every Year Many Children Injured From Unsafe Children’s Products

Despite the best efforts of the CPSC, every year many children are injured and some die due to unsafe and defective products which manage to slip by. Most recently there have been problems with toys in which small batteries could easily be removed and swallowed by small children. Those small batteries may seem innocuous, but they cause severe injury to the stomach and intestinal tracts of children and have resulted in deaths.

If you or a family member is injured or worse from an unsafe product or toy, you have the right to seek compensation for those injures and expenses. A personal injury attorney who handles product liability cases can give you advice about your product liability claim.

Most personal injury attorneys offer a free initial appointment to look over the circumstances of your accident injury claim and let you know about the strength of your claim and what options you have. Serious injury from consumer products and unsafe children’s products can cause a great deal of financial stress on a family from medical expenses, therapy, ongoing care and more. Getting full and fair compensation for those injuries that were caused by an unsafe or defective product can help cover those expenses and help a family deal with the injury and recovery.
